I don't think Your neighbor is 100 % sane, throwing fags over a fence is proof of that!
Can be a huge challenge to solve a problem a rational way, when only one part is thinking rationally... Good luck, I would also start the politely friendly way.

Father in law had a problem with a neighbour letting his dog sh--e out side his gate so he set a camera up to see who it was over a few days
When he found who it was a bucket full of shi-- when down the culprits drive never happened again.

Just do what I do have out with anyone, haven't spoken to next door in 2 years now he's moving, that was over him parking his car on shared drive,am away ATM, and if new ones there when I return I say don't fu..king park you car there or I remove it ,
I find softy softy doesn't work
