As Gatso cameras photograph the rear of the vehicle someone should question why the driver was speeding in reverse whilst steering one handed.
The registered keeper is liable if the driver cannot be identified. No points, because the offense is a different one of failing to provide the identity of the driver. One defense which has worked is where two drivers were driving the vehicle on the day in question, and neither can remember who was behind the wheel when the camera went off. Additionally, Plod have six months to preosecute following identification of the driver, and have been known to lose paperwork in long protracted cases which exceded their attention span.
