Use of video clips

If some one was to use a video clip of an item, in conjunction with the sale of that item, would they need to seek permission of the owner / creater of the video clip before doing so?

edit: or would it just be a matter of courtesey?

Legally the copyright for video (and photographs) is owned by the artist, that is to say the person who operates the camera. Even if you pay someone to take the video they will own the copyright unless there is an EXPRESS contractual term assigning copyright to you.

If you already own a copy of the video then showing it to someone else is not likely to cause a problem - however posting it on the net or distibution via email is more of an issue. I think most people would be fine with it.

If the video is already on the web and you just post a link to it then you would not be infringing the copyright (although it can be a grey area that pisses people off - its best to link to the "host" html page rather than just to the video file - so that the context is obvious) but out of courtesy you might want to tell the host as their server may get a few extra hits if your ad is popular. Of course this assumes that the original publication on the web had the consent of the copyright holder.

errr..... ye it think that makes sense. In this instance I would say no copyright rules have been broken as it just a link that has been used to the video clip.

Just in case anyone knows what I am refering to then I'm not bothered about it, I was just merely interested in the legality of it. But if it helps sell the item then a beer wouldn't go a miss!

I plead guilty. Will be happy to offer more than beer! Should have asked permission, but I am afraid I actually never even considered it. Really bad behaviour, no excuses. Yes, this is a crawling apology.

Dealing with the legal aspects, just for a moment. If I had copied the video and put it on my site, clearly there is a copyright issue.

If I had put a link on my site to the RibNet site specifically to that video, I think there might be an issue.

If I put a link on Ribnet referring to another thread on Ribnet where your video lies, is that an issue?

I simply do not know.

I will repeat. I behaved crassly, without due consideration, whatever the legals, and I am sorry for not being more thoughtful and appreciative. [I did put a 'thank you' note on the post.]

I think that using it commercially, is different to using it privately..

Bruce, I honestly don't mind you using it and I hereby give you permission to use the video in any sales promotion for the Prime! Its a pretty crap video though!!

I just want to reiterate that this thread was in no way designed to be a dig at Bruce for using my video. I was just simply interested in the copyright law for videos for my own knowledge as you often hear off people using pictures found on other internet sites for their own use on their websites etc.

Bruce, I still have the original on the tape so if you want a higher definition version of it your more than welcome.

GRAY I HATE U AND U KNOW Y!!!!

As for copywright laws pictures are the photographer/video persons property including all rights, but u cant take them from elsewhere and use them as those rights belong to someone else, the only ones you need to be carefull of are if children are in the photos, then you are best off getting the guardians consent before takin' em for obvious reasons

'splashing' the video will mean it probably wont work, electrics and water tend not to go too well together!!

So if you changed the video it wouldn't be quiet the same in characteristics and performance as the original.....

If you want to go technical, then u could change the footage and have new footage, but the original footage was under copywright and if you didnt have the authorisation to use the original, then you couldnt change it and therefore the 'new' one couldnt have been made and therefore you would be in breach of copywright, SORRY TO SPOIL THE FUN

Bruce it is Generally considered acceptable to link to another page (or video/ image) in context so yes that would be acceptable - and this is really the underlying principal of the internet.

No its not. Copyright infringement is copyright infringement. The difference is that there is limited value in pursuing an individual rather than a corporation.
