Tohatsu 9.8 2-stroke on Ebay

A much newer than usual Tohatsu 9.8 2-stroke being offered on Ebay by Ash Marine. It's in Devon but pallet delivery available.

I had noticed that 9.8 Tohatsu and thought, is that a legal way to circumnavigate the law re: the sale of 2 stroke outboards?

I don't think so as I believe the restriction continues when sold used. A private person could perhaps claim ignorance if ever challenged but a dealer would be held accountable.

I can't find the .GOV document. I remember it was quite wordy and open to interpretation with phrases like "placed on the market" but I am less clear about the putting into use aspect.

I doubt anyone is going to get the "illegal two stroke police" knocking on their door, there must be tens of thousands of illegal Chinese clones knocking around with fake CE marks on them & no one bats an eye. Why does it make a difference because the engine came from a bona fide manufacturer.

Someone l know bought a new one back in around 2011 from Mainbrayce Marine in Guernsey.
They had to pay various import taxes/shipping etc but the total cost was around £1700 back then.

He took it with him to Gibraltar when he moved there, but l've not heard from him for years.
Would it be legal to use it there?

l've looked at their website and they are still advertising the 2-stroke engine but the picture shows the 4-stroke version so maybe that loophole came to an end.

When just Googling around this subject I came across the seemingly odd situation in The Netherlands...

**Two-stroke outboard motors older than 2007 are not permitted for use within Amsterdam. If you bought your motor in the Netherlands after 2007, you do not have to do anything. An outboard motor must at least comply with the European regulation 2003/44/EC.**

I'm assuming it means legally purchased in The Netherlands post 2007 which would of course exclude all the conventional small 2-strokes available from 2007 to date.

My Tohatsu 9.8 is around 14 years old, it's been totally reliable and starts immediately even after not being used since the previous year.

l finally got around to doing a proper service after this season. Although the total hours from new are probably no more than 300.
