Their assumption is that you are scrubbing a hull that has been previously antifouled. The concern is that the mechanical action will release more antifoul into nearby drains and waterways. It is a potentially serious problem, depending on the receiving waters.

they won't ban it, they are just trying to find a way of charging you for it.
they say they will ban and when they relent and charge you a fee you will feel thankful not having it banned.
