Has anybody on here dealt with ED CAR (RIBRAFF).www.ribtube.co.uk

I ask the question because this chap bought a Rib from me on Ebay on the 16th Feb.
To date he has made many excuses but has so far failed to pay for the Rib. A mere £495.
Have any of you had any business dealings with this man?
Is he an honourable chap who is likely to pay his debts or is he a complete and utter timewaster?
I have already started the non paying bidder business and unless he contacts me to complete the deal then I will as I have done with two previous non paying bidders take County Court Action against him for non payment.
This will of course cost him much more in the long term as I have previously been awarded the price of the item, all legal costs and also expenses.
It will also of course damage his credit rating for the next six years and affect the Good Name of his business (If it has one).
He does not answer phone calls, text messages, emails or voice mails.
His last offer was to put a proverbial cheque in the post on Monday. It has of course never arrived.
If anybody has any information on this chap I would appreciate it and all thoughts and comments are of course helpful.
He might be a Trade Member on here but I would urge you all to be very wary before undertaking any business with him at all.
All he has to do is the honourable thing and pay me.
I shall await his call.

Perhaps. Have you ever publicly "named and shamed" a debtor before a court case? My legal lot certainly advised me against it, and in my case, the individual had the goods as well! In any case, I wish you the best of luck in court. I shall think of it as The Clash of the Cartoons

Not in my experience .. case law and experience counts for nout sometimes ... you have to convince the judge on the day .. and if its a technical matter .. that isnt easy !!

Yes twice and as long as what is said is the truth (which it is) and accurate (very) then it does not hinder your case in the slightest.

I am having several PM's already. It seems it has happened before with him.

I know it is a pain to advertise an item, wait until the end of the auction, and then the buyer does not turn up.

But I would not name someone who may well be a member of this site here.

yes i have dealt with ed and had no problem, i found him to be honest and helpful, although communication is certainly not his strong point, i am the same i will go months without looking at emails sometimes, and when i am really busy i have stopped the phone ringing with a lump hammer a few times,

I may be wrong as we don't have CCJ's up here - but I think on receipt of a Judgement there is a time (a few weeks?) when complete payment can be made and no record is kept (this allows for people who are willing and able to pay but who dispute the validity or value of a claim).

Obviously the right thing for Ed to do is contact you, let you know what is happening. Whilst that sounds easy - its not the easiest thing to admit you are having cash flow troubles.

my understanding is since he is in breach of contract (assuming everything you say is accurate) that he would be liable for your damages as a result of the breach - i.e. the cost of re-advertising, storage, any (negative) difference between the price he offered and the price you get, etc not the full offer price (since you still have the goods - and will now be free to sell them to a third party (by initiating the "non payer process" on ebay).

Of course most people on here dealing with him will be getting tube work done where they own him money and not the other way round - so you're "don't touch him with a barge pole" message might be a bit OTT.

I can see why you are annoyed - but as you say its only £495 - and (without looking at the boat) you'd probably get a similar price again - so your only loss is some time (as ebay will refund the fees) - compared to wasting more time on a court case, and potentially court fees, enforcement expenses - when a very long time later you might still not have any cash to show for it (the reality is if he's in cash flow problems, he'll end up repaying in instalments and of course bankrupcy / liquidation is always a risk too). Might be time to move on knowing you've already probably had more damage to Ed's reputation with this thread than an "annonymous" court case?
