no point sitting in a cafe moaning about it ...get round his place and demand it... i wouldnt leave with out either the money in my hand or something to the value of what he owes you then id name him anyway

Hi guys,
Thanks for all the support!
The charter company in question is in Portsmouth and I am about 8000 miles away in cental Laos about to go to Vietnam. So I cannot go and see him, that would be my first thing to do, I spoke to him several times on the phone and he made numerous promises to pay which have not happened. Court would be good but I cannot make my case very well from here as I would need to attend.
The guy is just dicking me around in a very unfair way.
I think selling the debt is probably my best case in this situation.

Unless you have a signed written agreement you cant do this legally, you can of course send the boys round.
You need to issue a letter/email offering 30 days to pay before court, this will help things later on, the chances are you wont have to go to court and the process can be started on line (google money claim online) and you can provide your prosecution statement online. In my experience i would not recommend this process, the bastard normally get away with paying you £1.50 a week interest free for the next 78 years.
The guy probably wants to pay you buts hasn't got the money, why not offer a few options-
1. accept paypal so he can pay you by his credit cards or his mum/wife's credit cards
2. offer for him to pay by installments by post dated cheques

The man speaks sense. Your worst case is you get a court order, he goes bankrupt (or if its ltd co it goes bust) and you will probably get nothing (but still have to pay the court fees). Good chances that any significant assets (i.e. boats) are already spoken for by the bank and that there are other creditors too.
It sounds like he is either really disorganised or can't pay you (or both). Otherwise he would be arguing about quality/delivery etc. Will this thread encourage him to be more proactive - maybe?

Mark - the spouse will not always automatically be the "executor" of the estate; accordingly whilst she is aware, she may not have the responsibility for sorting it out. The banks / credit card companies seem to address their letters to "The Personal Representative of the Late Mr XYZ" or if they have been told who is dealing with the estate "Mr ABC as Personal Representativie of the Late Mr XYZ".
Assuming he passed away fairly recently (certainly less than 6 months ago) then I would send a letter addressed like that. Mrs XYZ will be quite used to getting them and if she is not dealing with the estate will pass them to her solicitor or whoever is. If she is dealing with it then I think she'll see it as a "bill" rather than anything "personal".
If its more than 6 months since he died then you probably need to speak to a solicitor for advice (if it is enough money to justify it) as the estate is normally sorted out by then (and in some simple cases possibly sooner).
You should be aware that it is quite possible for debtors to get nothing when someone dies depending on the value of moveable assets. (Depending on the details of his financial affairs etc - which you won't be aware of - but his personal representative should advise you of if unable to pay).
Any specific "advice" in here is based on my personal experience of the Scottish system - whilst it is very similar in England there are subtle differences and if its lots of money at steak I would speak to a solicitor.

I think I will do the small claims thing and then publish the court documentation for everyone to see.

Chaps. This thread is about me.
To put things into perspective, we are talking about £129 here, which, at the time of writing, was billed to me 16 days ago (30/10/09 to be precise). Payment for the amount has now been made.
Since the email of the above date, I have received two messages, one email (the day after the first), and one on facebook from Stephen. I have received no other communication.
At no point have I disputed the amount owed, nor refused to make payment. I hope that brings this matter to a close.
